Nothing on the Site constitutes a binding offer to haul freight until confirmed in a written rate confirmation, bill of lading, or other agreed contract documents.

4. Transportation and Logistics Services
4.1 Governing Documents
Freight transportation services are governed by the applicable rate confirmation, bill of lading, tariff (if any), and these Terms. In the event of a conflict between Site content and a signed or electronically accepted rate confirmation or bill of lading, the rate confirmation and bill of lading control for that shipment.
4.2 Carrier Authority and Compliance
DEMIRAT LLC operates under MC 1711934 and DOT 4370909. Shippers and brokers are responsible for providing accurate shipment details, including commodity description, weight, dimensions, special handling requirements, and any hazmat or temperature-control needs.
4.3 Liability for Cargo
Where applicable, liability for loss or damage to cargo moving in interstate commerce may be subject to 49 U.S.C. § 14706 (the Carmack Amendment) and related regulations, subject to any lawful limitations of liability, released rates, or contractual terms set forth in the applicable shipping documents. Claims procedures, time limits, and documentation requirements will be as stated in those documents and applicable law.
4.4 Rates, Accessorials, and Payment
Quoted rates are estimates unless confirmed in writing. Accessorial charges (detention, layover, lumper, redelivery, truck ordered not used, and similar items) may apply as disclosed in the rate confirmation or industry-standard practices. Payment terms are as agreed in writing; overdue amounts may accrue interest and collection costs to the extent permitted by law.
4.5 Customer Obligations
Customers and tendering parties agree to:
- Provide accurate and complete load information
- Ensure freight is properly packaged, labeled, and ready at the agreed time
- Comply with all applicable shipping, safety, and hazmat requirements
- Secure any required permits or special authorizations for the commodity
5. Communications and Third-Party Platforms
We may communicate with you by phone, email, SMS, or integrated platforms such as RingCentral regarding quotes, dispatch, tracking, billing, and customer support. By providing contact information, you consent to receive service-related communications. Message and data rates may apply for SMS. You may opt out of SMS by replying STOP; for help, reply HELP or contact info@demirat.net. 6. Intellectual Property

TO THE FULLEST EXTENT PERMITTED BY LAW, DEMIRAT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON SITE CONTENT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our aggregate liability arising from use of the Site (as distinct from liability under a specific shipment contract or applicable cargo liability law) shall not exceed one hundred U.S. dollars (USD $100) or the amount you paid us, if any, for Site-related services in the twelve (12) months preceding the claim, whichever is greater.

Subject to any mandatory venue or jurisdiction rules applicable to interstate motor carrier claims, you agree that state or federal courts located in Cook County, Illinois, or such other venue as we designate in a shipment contract, shall have exclusive jurisdiction over disputes arising from the Site or these Terms, and you consent to personal jurisdiction there.
13. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page with a revised "Last updated" date. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms. For active shipments, the terms in effect when the rate confirmation or bill of lading was accepted will generally apply to that shipment unless otherwise agreed in writing.
14. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with any applicable rate confirmation, bill of lading, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and DEMIRAT LLC regarding the Site, and supersede prior or contemporaneous understandings relating to Site use. Failure to enforce any right is not a waiver of that right.
